What is the FLSA overtime rate?
Under the Fair Labor Standards Act (FLSA), non-exempt employees must be paid at least 1.5 times their regular hourly rate for all hours worked over 40 in a workweek. This is commonly referred to as "time and a half." The federal minimum wage for overtime is $10.88/hour ($7.25 x 1.5).
When does double time apply?
Double time (2x the regular rate) is not required by federal law but is mandated in some states. California, for example, requires double time for hours worked beyond 12 in a single workday and for all hours worked beyond 8 on the seventh consecutive day in a workweek. Some union contracts also include double-time provisions.
Who is exempt from overtime pay?
Salaried employees earning above the FLSA salary threshold ($58,656/year as of July 2024) who perform executive, administrative, or professional duties are generally exempt from overtime. Certain other workers like outside salespeople, computer professionals earning $27.63+/hour, and some seasonal workers may also be exempt.
